Foods determined to be of minimal nutritional value, as defined by the U.S. Department of Agriculture, shall not be sold in the food service areas during the breakfast, lunch, or supper periods. 7 CFR 210.15(b), 220.12

TEXAS DEPARTMENT OF AGRICULTURE POLICY

Effective August 1, 2004, all districts participating in the federal Child Nutrition Programs must comply with the nutrition policies outlined by the Texas Department of Agriculture.

Exceptions

The School may not adopt any rule, policy, or program under Education Code 28.002 that would prohibit a parent or grandparent of a student from providing any food product of the parent’s or grandparent’s choice to:

  1. Children in the classroom of the child on the occasion of the child’s birthday; or
  2. Children at a school-designated function.
